You also agree that we may provide all legal communications and notices to you electronically by posting them on our website or, at our election, by sending an e-mail to the e-mail address you provided to us when you registered at our website. You may withdraw your consent to receive communications from us electronically by contacting us.
1.1 'Bootcamp Course' means a 4 week fitness program consisting of at least 1, 2 or 3 exercise classes per week, and optional nutrition program
1.2. A 'Bootcamp Course' Membership entitles the fitness2improve Bootcamp Member, membership to the chosen Bootcamp course taking place on the dates, times and at the location specified at the time of registration.
1.3. 'TheSpinBox booking' is a booking made for an individual session or number of sessions for use on the Indoor Cycling Bikes only. Payment cannot be transferred unless a minimum of 12hrs notice is given.
1.4. An anti gravity booking is specific to the session that is pre-booked and no others and is a booking for an individual session on the date pre booked, if a transfer is needed then this must be done in discussion with the instructor.
1.5. 'Bootcamp Card' Specific card purchased for Bootcamp sessions in Ellesmere at Basecamp.
1.6. 'Service' means collectively any online facilities, tools, services or information that fitness2improve makes available through the Web Site either now or in the future;
1.7. 'fitness2you' refers to items/services purchased for home participation included: 14 day fatburner, continuation club, Downloadable workouts, DVD's
2. Monthly payment by S/O
2.1. A monthly standing order membership entitles the fitness2improve Bootcamp Member / Basecamp member, membership to each Bootcamp / session at Basecamp which takes place during the term and is applicable to their class of membership i.e. unlimited access
3. Refunds and Cancellation
3.1. Once purchased, memberships, spin sessions, Bootcamp Courses & Session cards are non-refundable and non-transferable unless agreed with Danni Evans Company Director.
3.2. A 'Bootcamp Course' term time block of sessions cannot be refunded & not continued into another fixed period i.e. the next term.
3.3. On expiry of the 'Bootcamp Course' block of sessions you must make payment for the next block in advance of the next block or on the first day of the course
3.4 Standing Orders will continue on a month by month basis until cancelled by giving one months notice in writing.
3.5 Block purchases of any session cards from fitness2improve have a shelf life of 6 months. After which they cannot be used, refunded or transferred
3.6 The owner of a block of sessions is responsible for the production of their Block Booking Card for the instructor to sign off to record usage. The instructor will maintain a log of clients' and their usage
3.7 Refunds will only be made at the discretion of the Director, Danni Evans, under exceptional circumstances or in the case of a place booked on an Educational Course, though the deposit will be retained.
3.7 In the case of a refund this will be agreed by Director, Danni Evans, and refunded in the format in which I was paid, i.e. via electronic payment, cash or cheque
4.1 In the case of a cancellation, you must give 12hrs notification for a booked Group Indoor Cycling class, Bootcamp or Anti Gravity course to be eligible to transfer to an alternative day & time.
4.2 Whole Bootcamp courses can be transferred but weeks cannot be carried over as part of a course.
4.3 Education course places may be cancelled, a refund will be issued up to 2 weeks prior to the course, but the deposit will be retained. If cancellation is within 2 weeks of course start date half the course cost will be refunded.
5.1 Any items (non class, bootcamp or any 'service') purchased may be returned within 21 days, with proof of purchase and unopened and within their original packaging. A full refund will be issued on receipt if undamaged.
6.1 Where delivery is applicable (non class, Bootcamp or any 'Service') this will be charged at standard delivery rate based on weight and size of item, according to the Post Office delivery charges.
6.2 Delivery of any item will be made immediately where possible, purchaser will be notified of anything different.
7. Health and Safety
7.1. The Basecamp/Bootcamps member shall notify their instructor if they suffer from any health conditions or injuries
7.2. If, after completion of the health questionnaire, anything occurs it is the responsibility of the client to inform the instructor
7.3 Non-disclosure of any illness, health problem or injury by the client which is aggravated by any given exercise is not the responsibility of the instructor
7.4 Fitness2improve Bootcamps/classes/spin sessions/fitness2you purchases/education courses/Basecamp shall not be liable for any loss or injury attributable to:
(i) the fault of a fitness2improve client
(ii) a third party unconnected with the provision of services provided by fitness2improve Bootcamps or sessions at Basecamp
(iii) events which neither the fitness2improve Bootcamps nor their suppliers or agents could have foreseen or forestalled even if they had taken all reasonable care.
7.5 Children are welcome at Basecamp but parents bring them at their own risk, there is a seating area provided with a selection of toys and wi-fi is available if electronic devices are brought with them. Parents are informed of the risk to children when first coming to Basecamp especially in the gym area.
8. Intellectual Property
8.1 Any marketing, educational or other materials produced by the fitness2improve Bootcamps, Basecamp, The Spin Box, Fitness2you or Education, and made available to Bootcamp members will at all times remain the property of the fitness2improve Ltd and will be subject to copyright. The fitness2improve Ltd client undertakes not to copy publish or reproduce any such materials.
